19-Year-Old Waives Hearing on Charge of Possessing Marijuana in McCandless Park

A 19-year-old Oakland man waived his preliminary hearing before Magisterial District Judge William K. Wagner Wednesday on misdemeanor charges of possessing marijuana and drug paraphernalia in a McCandless park.
McCandless police charged Aric Michael Makal after finding him in Wall Park about 10:30 p.m. Aug. 11 at a picnic table with suspected marijuana and drug paraphernalia, according to the criminal complaint.
While patrolling the park, McCandless Police Officer Sabrina Devereaux noticed a silver minivan by a park pavilion and two males sitting at a picnic table, the criminal complaint states.
She asked the men, Makal and Matthew Guarnera, why they were in the park after it closed, and Makal said he did not see the sign at the park entrance stating it closed at dusk, the complaint states.
Guarnera, 19, also is charged with possessing marijuana and drug paraphernalia; his preliminary hearing is scheduled for Oct. 17.
Makal told the officer they were about to light up a cigar and that it was legal because both males were over age 18, the complaint states.
As the officer approached the picnic table, she could see a clear Mason jar with suspected marijuana inside and asked the men if they had anything illegal, to which the men answered “no”, according to the complaint.
“(The officer) asked Makal about the Mason jar and he stated it was just marijuana seeds and again they were over 18 so it was legal,” the complaint states.
Numerous paraphernalia items were in plain view on the table and several different bottles containing suspected marijuana, the complaint states.
“On the ground behind Makal was a large water bong filled with water, which Guarnera took ownership. On the ground beside the left foot of Makal was a green zippered pouch containing a marijuana pipe and baggie of suspected marijuana inside a Tylenol bottle.
“On the table in between the two was a pill bottle with a baggie of suspected marijuana and an Altoids can with a baggie of suspected marijuana. There was a black duffel bag that Guarnera stated was his and inside that was a Centrios camera case containing a marijuana pipe, two screwdrivers, two Sharp crushers containing suspected marijuana, a pill bottle containing suspected marijuana, a white smoking device and a marijuana pipe,” the complaint states.
On top of the bag were two white Frisbees containing suspected marijuana residue, according to the complaint.
Lighters and rolling papers were on the table along with a large bottle of water used for the bong, the complaint states.
All the items were confiscated and sent to the crime lab for analysis, the complaint states.
